TERMS AND CONDITIONS

 Definitions

The terms used in these Terms and Conditions have the following meanings:

- PASSWORD – a sequence of alphanumeric characters necessary to receive authorization in the process of obtaining access to the Account, set independently by the Customer during the Registration process.

- CUSTOMER – a natural person with full legal capacity and, in the cases provided for by the generally applicable provisions – a natural person with limited legal capacity; a legal person or an organizational unit without legal personality to whom an act has granted a legal capacity, and which intends to conclude or has concluded a Sale agreement or an Agreement for the provision of Electronic service.

- CIVIL CODE – the Civil Code act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).

- CONSUMER – a natural person for whom the conclusion of a Sale agreement or an Agreement for the provision of Electronic service is not directly related to its business or professional activity.

- ACCOUNT (CUSTOMER ACCOUNT) – subpage in the Store, where data about, among other, the Customer’s Orders in the Online store are being collected.

- PRODUCT – a movable available in the Online store which is a subject of the Sale agreement between the Customer and Seller.

- REGULATIONS – these regulations of the Online store.

- REGISTRATION – one-time action involving the creation of the Customer Account completed using the registration form provided by the Service Provider on the Store’s website.

- ONLINE STORE (STORE) – the online store of the Service Provider available at www.evoepharm.com through which the Customer can conclude a Sale agreement or an Agreement for the provision of Electronic service.

- SALE AGREEMENT (AGREEMENT) – an agreement for the sale of a Product within the meaning of the Civil Code concluded via the Online store.

- ELECTRONIC SERVICE – a service provided electronically by the Service Provider via the Online store.

- PROVIDER – Evoepharm Ltd., Grzybowska 87 Street, 00-844 Warsaw, Poland registered at the District Court in Warsaw, XIVth Economic and Registration Division, under the , KRS: 0000871881, NIP (Tax Identification Number) 5242910501, REGON (National Register of Business Entities number) 387674891, e-mail: info@evoepharm.com

ORDER – the Customer’s declaration of intent aimed directly at the conclusion of the Product’s Sale agreement and determining its essential conditions.

 Sale in the online Store is based on the Terms and Conditions of this online Store, which every Customer should read before ordering.

The Store reserves the right to change these Terms and Conditions in full, or any part of it, at any time without prior notice. The Customer is not bound by the provisions of the Terms and Conditions that were changed after the order was made. By buying products in our Store, the Customer accepts these Terms and Conditions.

 The Service Provider provides the following Electronic services via the Online store:

-Customer account in the Online store;

-The interactive form which allows Customers to submit orders in the Online store.

-Newsletter

 Functioning of the store

  1. Our Store sells products online. We offer 24/7 service, 365 days a year. As a result, orders can be made 24/7. All orders are shipped within 48 hours of receipt of the order at the latest or payment of amounts due by the customer. Orders placed on non-working days will be shipped within 48 hours at the latest, counting from the first business day following the order placement.
  2. We sell only new products that have no physical or legal defects.
  3. All products available in our Store are physically in stock in our warehouse and their status is updated every day. However, information on the availability of products may be changed without prior notice.

Prices

  1. All prices are in the currency of the country for the selected language version. Gross price containing the applicable VAT rate is indicated with a full description of the goods. The price of each product given when placing the order is binding and will not change until the payment is made.
  2. The Store reserves the right to change the prices of products available in the Store, introduce new products, make and withdraw special offers on the Store’s websites or make changes to the websites.

 Orders

  1. Orders are made by filling the order form placed on the website in the right way.
  2. Orders can only be made by people that have registered and have an account at the Store, or those who will provide all information necessary to carry out the transaction.
  3. Each order made by the Customer is confirmed – we send an e-mail informing the Customer that we have received the order.
  4. The Store reserves the right to verify the order. If there is no contact with the purchaser or the order cannot be verified, the Store reserves the right to suspend execution of the order
  5. Accepting Terms and Conditions, the buyer agrees to issue and send an electronic invoice to the e-mail address provided in the order.
  6. As a result, the buyer agrees that submitting the invoice to the e-mail address provided in the order is tantamount to confirming its receipt.

Returns and Complaints

Contract Termination

Under Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council Text with EEA relevance the Seller shall notify the Customer that he/she is entitled to withdraw from the contract within 14 days from the date of delivery. The date of shipment prevails.

The returned product must be new, with no signs of use, originally packed and with intact seals on the box.

The customer should also send an e-mail containing the order number and bank account number enabling the refund of the amount paid.

If the above-mentioned conditions are met, the money will be refunded no later than 14 days from the date of receipt of the return shipment.

 Complaints

The seller is responsible to the customer for the non-compliance of the ordered goods with the contract in accordance with the applicable law.

If the customer finds that the delivered goods are inconsistent with the contract (defective), a complaint should be made. It is recommended to submit a complaint by mail, by returning the goods with the attached "Complaint Form". The shipment may be made by registered mail, parcel or other form of shipment, to the address of the Seller's seat, with the note: "Complaint":

The customer may also contact the Store regarding the complaint by e-mail to the following address:

Each time the customer is obliged to complete the "Complaint Form", providing all the data contained therein.

The customer will receive information on the method of considering the complaint within 14 days from the day following the receipt of the parcel containing the goods complained about by the store. If the complaint is accepted, the Seller will provide the Consumer with a full-fledged product (repaired or new), and if it proves impossible (e.g. stock depletion), will return the full amount of the price of the goods together with other costs incurred. The above provisions do not limit the consumer's rights under applicable law.

If the complaint is not accepted, the goods will be sent back together with the opinion as to the unjustified nature of the complaint.

 Final provisions

  1. In matters not regulated herein, the provisions of the law in force in the Republic of Poland, including the Civil Code, the Act on the provision of electronic services of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended);
  2. The Act on the protection of certain consumer rights and liability for damage caused by dangerous products of 2 March 2000 (Journal of LawsNo. 22, item 271, as amended); the Act on specific terms of consumer sales and on the amendment to the Civil Code of 27 July 2002. (Journal of Laws No. 141, item 1176, as amended), and other relevant provisions of the Polish law shall apply.
  3. Disputes arising between the Service Provider, the Seller and the Customer who is also a Consumer shall be submitted to common courts. Disputes arising between the Service Provider, the Seller and the Customer who is not a Consumer shall be submitted to the competent court proper for the seat of the Service Provider or the Seller.
